Terms & Conditions for using data by challenge partners

These terms and conditions for using data provided by challenge partners apply to the InnoDays (“EVENT”) hosted by conui GmbH (“ORGANIZER”), a company registered Austraße 96, 6800 Feldkirch, Austria.

 

By participating in the event and utilizing the data provided by challenge partners, you agree to the following terms and conditions:

  1. Ownership and Use of Data: The data provided by the challenge partners remains their intellectual property. Participants are granted limited rights to use the data solely for the purpose of the event and developing solutions for the specified challenges.
  2. Confidentiality and Non-Disclosure: Participants acknowledge that the data provided may contain confidential and sensitive information. Participants agree to maintain strict confidentiality and not disclose or share the data with any unauthorized individuals or third parties.
  3. Permissible Use: Participants may use the provided data solely for the purposes of the event, including analysis, visualization, and developing innovative solutions. Any use of the data beyond the event requires explicit permission from the challenge partners.
  4. Data Protection and Privacy: Participants are responsible for ensuring the security and proper handling of the data. Personal data within the provided data must be treated in compliance with applicable data protection and privacy laws. Participants should not attempt to re-identify individuals from anonymized data.
  5. Intellectual Property: Any intellectual property developed by participants during the event remains their own. However, PARTICIPANTS are aware that the COMPANIES intend to use the WORK RESULTS (or parts of them) commercially. If the COMPANY expresses such interest, the following applies (see Right to first refusal in the InnoDays General Terms & Conditions):
    – The team of PARTICIPANTS, who contributed to the creation of WORK RESULTS, first gets an opportunity to work together with the COMPANY on their further development (“right of first refusal”)
    – If the entire team of PARTICIPANTS is not interested in such further processing, this right also applies individually to each member of the team;
    – Finally, if no team member expresses such interest within one (1) month after the EVENT, the COMPANY is free to use, process, and further develop the WORK RESULTS in their own name without further involvement by the PARTICIPANTS.
  6. Accuracy and Validity: Participants are responsible for verifying the accuracy and validity of the provided data. Challenge partners do not guarantee the accuracy, completeness, or suitability of the data and shall not be liable for any consequences arising from its use.
  7. Compliance with Laws and Ethical Standards: Participants agree to comply with all applicable laws, regulations, and ethical standards while using the provided data. Participants shall not engage in any activities that are illegal, unethical, or harmful.
  8. Indemnification: Participants agree to indemnify and hold harmless the challenge partners from any claims, damages, or liabilities arising from their use of the provided data or their participation in the event.
  9. Limitation of Liability: Challenge partners shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of the provided data or participation in the event.
  10. Modification and Termination: Challenge partners reserve the right to modify or terminate the availability of the data and the event at their discretion. Participants will be notified of any changes or termination as deemed appropriate.

By accessing and using the data provided by challenge partners in the event, participants acknowledge their acceptance of these terms and conditions. Failure to comply with these terms may result in disqualification from the event and legal consequences.
